The Importance of Keeping Asbestos Management Plans Up To Date and Compliance with Control of Asbestos Regulations 2012

All non-domestic properties have a duty to manage the risk of asbestos within their premises so that they comply with the Control of Asbestos Regulations 2012 (CAR 2012). The duty holder for the building is required to ensure a management plan is established that identifies any possible asbestos containing materials (ACMs) and how they will be managed in order to prevent any persons, including contractors, being exposed to asbestos.

The duty holder must make staff and/or contractors aware of any ACMs which will affect them; likewise, staff/contractors must make the duty holder aware of any suspect materials not noted on the asbestos register and of any change to the condition of existing ACMs.

How often should I review the asbestos management plan?

It is vital that the asbestos management plan is reviewed periodically, and as a minimum, every 12 months. However, this may be necessary sooner if there are any changes to the circumstances of the building. For example, if there are changes to the primary use of the building, or to the layout of the building (in particular refurbishment works), then the management plan must be updated to reflect these changes.

What should the review involve?

These periodic reviews should be undertaken by a suitably competent person and must involve the inspection of ACMs for any signs of deterioration or damage and plan any necessary repairs (encapsulation) or removals. The review should also establish and ensure that the procedures in place have been effective and all individuals are aware of their role in making sure they comply with the duty to manage. Any failures noted to the management procedures must be highlighted and amendments made to the management plan to ensure it continues to comply with the Control of Asbestos Regulations 2012.
