Dutyholder evidence – Control of Asbestos Regulations 2012- Post Implementation Review published

The Health and Safety Executive has recently published its findings from its ‘Post Implementation Review’ (PIR) of the Control of Asbestos Regulations 2012 (CAR 2012).  The PIR is a statutory requirement of the regulations – to assess the overall effectiveness of CAR 2012.  CAR 2012 sets minimum standards for the protection of employees and others from any risks connected to the exposure to asbestos.

The report highlights that CAR 2012 has had a positive impact and influence on workplace asbestos control regulations.  Overall, the regulations have met their objectives and have helped to achieve a high level of compliance.

The overall conclusion of these findings is that no major amendments are required to the regulations, and the CAR2012 provides a robust and effective regulatory framework from which to protect workers from the risks associated with exposure to asbestos fibres.  However, the report does highlight a few relatively minor improvements; such as improving information on the roles and responsibilities of duty holders in non-domestic premises – particularly in relation to how to conduct a management plan (along with practical examples), and the frequency of medical examinations.
